Gammalux Shipping Policy

Elemental LED, Inc., and its brand, Gammalux, together referred to as the “Company”. If there is a discrepancy between the below and the policy posted on the price sheet, the policy posted on the Website prevails.

Freight Policy and Shipments for Continental United States (48 states):

Full-Freight is allowed on any size order of $5,000.00 or more, when the total account is in current standing, and the order is paid for within terms printed on the invoice. All freight costs, regardless of order size, will be added to the bottom of every invoice issued by the Company. All Best Way standard freight charges (includes UPS ground with tracking, USPS first-class or priority with tracking, LTL and does not include overnight, second day, special deliveries, special arrangements, non-standard packaging and processing) may be deducted from invoice total ONLY when the total account is in current standing, and the invoice is paid for, in its entirety, within the specified terms printed on the invoice, and ONLY when order meets the $50 minimum order requirement, before freight costs; otherwise freight charges will apply. If the account is past due or the invoice is not paid for within specified terms, then the customer is responsible for all freight costs incurred to ship product to desired location. The Company reserves the right to use carrier of their choice, generally UPS Ground or equivalent. The Company can accommodate expedited shipping when necessary, but purchaser must bear the full cost of the shipping charges.

Freight Policy and Shipments for Alaska, Hawaii, Canada, Puerto Rico, and Caribbean Islands:

Full freight is allowed on orders of $1,500.00 or more, when total account is in current standing, and the order is paid for within the specified terms printed on the invoice. All freight costs, regardless of order size, will be added to the bottom of every invoice issued by the Company. All Best Way standard freight charges (includes UPS ground with tracking, USPS first-class or priority with tracking, LTL and does not include overnight, second day, special deliveries, special arrangements, and/or drop shipping) may be deducted from invoice total ONLY when the total account is in current standing, and the invoice is paid for, in its entirety, within the specified terms printed on the invoice, and ONLY when invoice total is at least $1,500.00; otherwise, freight charges will apply. If the account is past due or the invoice is not paid for within specified terms, then the customer is responsible for all freight costs incurred to ship product to desired location. The Company reserves the right to use carrier of their choice. Purchaser is responsible for all applicable customs charges, taxes, and duty fees.

Freight Policy and Shipments for Mexico:

Full freight is allowed on orders of $1,500.00 or more up to the U.S. borders ONLY, when paid for within the specified terms printed on the invoice. All freight costs, regardless of order size, will be added to the bottom of every invoice issued by the Company. All Best Way standard freight charges (includes UPS ground with tracking, USPS first-class or priority with tracking, LTL and does not include overnight, second day, special deliveries, special arrangements, and/or drop shipping) may be deducted from invoice total ONLY when invoice is paid for, in its entirety, within the specified terms printed on the invoice, and ONLY when invoice total is at least $1,500.00; otherwise freight charges will apply. If invoice is not paid for within specified terms, then customer is responsible for all freight costs incurred to ship product to desired location. The Company reserves the right to use carrier of their choice. Purchaser is responsible for all applicable customs charges, taxes, and duty fees.

Freight Policy and Shipments to Other International Locations:

The Company can accommodate international shipping as needed and will provide a quote for shipping at the time of the order. Purchaser is responsible for all applicable shipping charges, customs charges, taxes, and duty fees regardless of order size.

Expedited Shipping:

Expedited shipping can be accommodated when necessary, but purchaser must bear the full cost of shipping charges regardless of order size.

Shipping Dates:

Shipping dates are approximate and are based, to a great extent, on prompt receipt by the Company of all necessary ordering information from purchaser. The Company agrees to ship products to purchaser as close as possible to the delivery schedule set forth in each order as accepted by the Company, unless the Company otherwise indicates in writing. The Company shall make every effort to, but shall not be liable for failure to, honor any order which specifies a shipping date earlier than the Company’s then-current delivery schedule for the date such order is received by the Company. The Company uses common carriers and reserves the right to use carrier of their choice.

From Original Gammalux Shipments:

All shipments are Freight On Board from our shipping point and all goods are shipped at Purchaser's risk. Title to merchandise passes to Purchaser and Gammalux’s responsibility for safe and timely delivery ceases when merchandise is accepted in good order by the carrier. Your shipment will carry the standard insurance offered by the carrier.  This insured amount is less than the full value of your order.  Gammalux strongly recommends that you consider an additional optional insurance coverage for full replacement value.  Quotes available upon request.

Freight is allowed on single-release shipments of $12,500 value or more at standard DN price to any freight station in the continental United States. Additional fees may apply for non-standard freight requests. For shipments outside the continental U.S., freight allowance will be made to any port of embarkation within the continental United States. For orders below $12,500, or multiple releases, final invoice will reflect actual shipping costs which may vary from estimates. For will-call at the factory, a processing fee of $100 applies.

Payment:

Net 25 Days. No deductions will be allowed without written approval from Gammalux’s main office. Unauthorized deductions taken will be billed back to the customer. Non-payment of unauthorized deductions will affect credit terms on subsequent orders. Prices and shipments exclude lamps unless otherwise agreed to in writing.


All payments must be submitted in check form in U.S.D. or credit card with 3% service fee. Partial up-front payment, or pre-payment in full, may be required from new customers or others at Gammalux’s discretion. For Modified or Custom fixtures, Gammalux requires a minimum 50% deposit, at the time of order entry, with the balance due prior to shipment.

Interest Charges:

All late payments are subject to finance charges to the maximum amount permitted by law.

Cancellation:

Orders cannot be cancelled without written consent from Gammalux and then only on terms which indemnify us against loss. All cancelled orders are subject to a minimum 50% cancellation fee. Orders for custom-made equipment may not be cancelled.

Returns:

Under most circumstances, products are not returnable. In rare cases, products may be returned to Gammalux but will require a Return Goods Authorization to be issued by Gammalux in advance. Requests for RGA must be made in writing within (90) days from date of shipment. Return freight must be paid by Purchaser and restocking of 30% of the invoiced unit value will be assessed. Products returned for defects in manufacture or Gammalux error in shipment will be accepted at full credit including inbound & outbound freight.
